  • In January 2026, new areas of use in the client agreement

    At the beginning of January 2026, Gramex’s client agreement will be updated by decision of the general meeting. The agreement for both music performers and producers will change Gramex’s rights to license the use of music. New licensing areas include the use of music as background music for podcasts and the possibility to sell licences to libraries, archives and museums for the use of sound recordings and music videos that have been withdrawn from commercial distribution and thus considered “out of commerce”. The customer may choose to exclude the new areas from their contract.

    With the podcast licensing area, Gramex rights holders can authorise Gramex to grant music licences to podcast operators for programmes where music is used as background music as part of the podcast. 

    The second new area concerns the use of so-called out of commerce music by cultural heritage institutions. Under the updated Copyright Act, which is in line with the EU Copyright Directive, it must be ensured that licences for phonograms and music videos that have been withdrawn from commercial distribution can be obtained in one place. With the new scope of use, libraries, archives and museums, for example, will be able to obtain licences in a comprehensive way from Gramex.  

    As new licensing areas accrue remuneration over time, distribution of remuneration for performers and producers will be made in accordance with Gramex’s distribution principles.  

    In addition to the changes to the licensing areas, changes were made to Article 17 of the customer agreement to clarify the contract clause and to add the possibility of transferring customer data to the ISNI system. 

    How to check the wording of your agreement 

    The changes to the areas of use will enter into force on 1.1.2026. The new areas of use are listed in Article 1, paragraphs 4d and 4e of the Customer Agreement. 

    If they wish, artist and producer customers can exercise an opt-out right in respect of the domains, i.e. limit the authorisation they grant to Gramex. Opt-out notifications will be accepted for new areas of use after the end of 2026. The notification of the contract limitation must be made within three months from the beginning of January, i.e. by 31 March 2026 at the latest.
